Terms and Conditions
daponto is a customer loyalty platform that awards and manages points in partnership with member merchants. Use of the daponto platform implies full acceptance of these Terms and Conditions.
1. Account and registration
Account registration and access are carried out through the user's mobile number. The user may optionally link an email address in the account settings.
Use of daponto is restricted to persons aged 18 or over (or the legal age of majority in the user's country of residence, if higher).
The user is responsible for keeping their account access confidential and for the activity carried out through it.
2. User data and sharing with partners
When becoming a customer of a member merchant - by receiving points or using a voucher - the user accepts that this partner has access to a limited set of their data, necessary for the loyalty relationship.
The partner may view the name, country, age and the loyalty data relating to that partner (points, interaction history and ratings given).
The email address and mobile number are only shared with the partner if the user expressly authorises it in the settings. By default they are not shared, and the authorisation may be withdrawn at any time.
daponto follows the principle of data minimisation: the partner does not have access to the date of birth (only the age) or to any other personal data beyond those indicated in this section. For more information, see the "Data protection" section.
3. Points
Points are awarded by member merchants to users. Each partner is free to define the amount of points and the criteria for awarding them; it is common practice to award points proportional to the purchase amount, but this is not mandatory.
Whenever a partner awards points, the user simultaneously receives:
- Partner points - valid only in that partner's campaigns;
- daponto points - accumulated together across all partners and usable in daponto campaigns.
Awarding with identification: to receive the points directly in the account, the user identifies themselves to the partner, through the QR code of the account or the mobile number linked to the account.
Anonymous awarding: if the user does not identify themselves at the time, the partner may generate a code (or QR code) that allows the points to be redeemed later. Points awarded this way must be redeemed within the period indicated at the time of awarding (currently 15 days); after that period they expire.
Inactivity and points reduction: to keep the loyalty programme active and fair to everyone, points may be reduced in the event of prolonged inactivity. This reduction does not wipe out the balance at once - it decreases it gradually - and never makes the balance negative (the deduction is always limited to the points available).
- daponto points: if the user does not use their daponto points - by creating a voucher in a daponto campaign - during a grace period (currently 1 year), a fixed amount is then deducted for each month of inactivity that follows (currently 10 points per month). Every new use fully restores the grace period.
- Partner points: each participating partner may, while it remains active on the platform, set its own inactivity rule for the points it awards (grace period and amount deducted per period). Should the partner cease to be active, the daponto rule described above applies to those points.
The user is warned before any reduction, with guidance on how to avoid it (simply use the points). The values and periods indicated here may be adjusted; the version in force is always the one published on this page.
Points have no monetary value, are not convertible into cash and are not transferable. Improper or fraudulent use may lead to the blocking of the account and the loss of the points accumulated up to that moment.
4. Campaigns
Campaigns correspond to offers or discounts made available by the partners. Responsibility for the campaign and its content, including images and conditions, lies with the partner that creates it.
To enjoy a campaign, the user exchanges the required points and obtains a voucher.
5. Vouchers
The voucher is available in the user's account, with the description of the offer and its conditions. The voucher is not sent by email.
Vouchers may be:
- Partner voucher - created with partner points;
- daponto voucher - created with daponto points.
Any amount associated with the offer is paid directly to the partner.
Each voucher has a validity period. After that period, the user can no longer use the associated campaign, with no right to a refund of the points exchanged.
Campaign vouchers, once created, cannot be cancelled.
To enjoy the campaign, the voucher must be presented to the partner, who validates it or marks it as used.
6. Ratings
After a daponto voucher is validated, the user may rate the partner, within the period indicated (currently 15 days from the use of the voucher).
The rating covers several criteria - namely quality/price, customer service, service quality and location - and one rating per voucher is allowed.
Vouchers created solely with partner points do not grant the right to a rating.
7. Use of campaigns and liability
The beneficiary is understood to be the holder of the voucher. The terms of use apply equally to all vouchers, except where the terms of each campaign, set by the partner, establish their own conditions - which, in that case, prevail.
As a rule, and unless stated otherwise in the campaign terms, use must be arranged beforehand and directly with the partner, subject to the partner's availability. Conditions may apply regarding booking notice, changes, no-shows or combination with other promotions.
- The voucher has no monetary value and may not be sold, exchanged, replaced, returned, nor is it redeemable for cash.
- Vouchers that are illegible, damaged, falsified, duplicated or that do not match the campaign conditions will not be accepted.
- The partner may request an identification document to confirm the beneficiary's identity.
- Each partner's own terms and conditions also apply.
daponto is not responsible for the management, availability or provision of the service by the partners, nor for changes, cancellations or incidents in the use of the campaigns - responsibility for the offer and its fulfilment lies with the partner. In unforeseen circumstances or force majeure, the terms of use and the availability of the campaigns may change.
daponto is not responsible for technical failures (hardware, software, network, power) or for incidents originating from external causes. It is the beneficiary's responsibility to ensure they meet the conditions necessary for the activity covered by the campaign and to comply with the safety rules indicated by the partner.
8. Account blocking
daponto may limit or block accounts that breach these Terms or applicable law. A partner may also block a customer within the scope of its relationship with them; in that case, the customer can no longer receive points or create vouchers with that partner.
9. Personal data protection (GDPR)
daponto processes users' personal data in the context of providing the loyalty service.
- Data controller: daponto.
- Data processed: mobile number (account identification); optionally, email address; name; date of birth (used to display the age); country; activity data (points, vouchers, interactions and ratings); and service usage data (merchant and campaign pages opened, vouchers created, terms searched, date, IP address and origin of the access).
- Purposes: account creation and management, awarding and management of points, provision of campaigns and vouchers, communication with the user, and production of aggregate usage statistics - for partners, for abuse detection and for improving the service.
- Sharing with partners: limited to what is described in section 2; contact details (email and mobile number) are only shared with the user's express consent, which may be withdrawn at any time.
- Retention: data is kept while the account is active and for the period necessary to comply with legal obligations. The detailed usage record, which contains the IP address, is deleted after 90 days, leaving only aggregate counts with no link to the account.
- Data subject rights: access, rectification, erasure, restriction, portability and objection, as well as the withdrawal of consent. To exercise them, contact support@daponto.com.
Territorial scope: the General Data Protection Regulation (GDPR - Regulation (EU) 2016/679) applies to users located in the European Union and the European Economic Area. daponto seeks to apply the data protection and minimisation principles described here generally, regardless of the user's location; the specific rights provided for in the GDPR apply to data subjects covered by its territorial scope.
10. Changes and contact
daponto reserves the right to change these Terms and Conditions at any time, publishing the updated version on the platform. Periodic review of this page is recommended.
